Helping Clients Get Their Disability Benefits Faster Nationwide
Has your initial claim for Social Security benefits been denied? You have the opportunity to request a reconsideration and attend a hearing before an administrative law judge (ALJ). During the disability hearing, you will be able to speak with the judge who directly impacts the final ruling on your case.
With so much at stake, it is essential to acquire the assistance of an experienced legal team that can guide you through the process.
At the American Disability Action Group, our Arkansas SSD hearing attorneys understand how critical these hearings are for our clients, and we are committed to diligently crafting strategic cases and ensuring they are presented correctly before the judge.
Our Arkansas disability hearing lawyers can prepare you for potential questions you could be asked during the hearing, making sure you are ready to answer them honestly and thoroughly.
Expediting Your Disability Hearing
If you have been injured and can no longer make an income, your financial situation can begin to spiral out of control. Medical bills, mortgages, and other debts can begin to pile up, and you are left with no way to make payments. The last thing you need is to wait for a Social Security disability hearing. Many people wait nearly two years to get their day in court – not to mention the time it takes to receive the ALJ’s decision, which is often around 60 days.
The good news is that there are some situations where individuals can expedite the process. Our experienced lawyers can help you take the necessary steps to have quicker access to the disability benefits you need. There are several types of claims that are considered “critical cases” and will be processed more rapidly.
The Social Security Administration will expedite your disability claim if:
- You are in “dire need” of food, medical care, or shelter
- You are considered to be a threat to yourself or others
- You have a terminal illness
- You are a current or former military service member whose disability began while on active duty
- You have a medical condition that qualifies for a “compassionate allowance” (CAL)
Frequently Asked Questions for Disability Hearing Attorney
A disability hearing is the second level of the Social Security appeal process. It is an official proceeding presided over by an administrative law judge (ALJ).
Hearings do not take place in a traditional courtroom. Instead, a conference room or office services as the setting. The hearing is not open to the public. The ALJ may call a vocational expert and a medical expert to testify about your medical condition and the effect of a medical condition on your ability to work. Your disability attorney may also invite witnesses to testify in support of your claim.
Expect the ALJ and your attorney to ask you questions about the effect of your disabling medical condition on your ability to do daily activities, including those related to working. After the hearing, a written decision by the ALJ will be sent to your disability attorney.
Rely on an American Disability Action Group attorney to be there as your staunch advocate before and during the hearing. Your attorney meets with you before the hearing to prepare you to testify in support of your claim, whether the questioning comes from the ALJ or your attorney.
It takes several months from a request until the actual hearing date. Use the time to ensure that your current and up-to-date medical records are available for the hearing by attending all scheduled appointments with your doctors. If doctors recommend a treatment plan, continue following it and taking prescribed medications.
It generally takes two to three months before you receive a decision from an ALJ. Factors, such as the workload of the ALJ and complexity of the claim, could add to the time it takes for you to receive a decision.
If an ALJ denies your claim for disability benefits, you have 60 days to appeal it by requesting an Appeals Council review. The Appeals Council may deny your request for review or agree to review it. If it reviews the case, it can make its own decision about benefits or send it back to the ALJ for further action.
